| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 483.102, Health and Safety Code, is | ||
| amended by adding Subsections (a-1) and (d) to read as follows: | ||
| (a-1) The commissioner of state health services or, if the | ||
| commissioner is not a physician, the chief medical executive of the | ||
| Department of State Health Services shall issue a statewide | ||
| standing order prescribing an opioid antagonist to a person | ||
| described by Subsection (a)(1) or (2). | ||
| (d) The commissioner or the chief medical executive who | ||
| prescribes an opioid antagonist under a standing order as required | ||
| under Subsection (a-1) has official immunity and may not be subject | ||
| to any criminal or civil liability for: | ||
| (1) issuing the standing order prescribing the opioid | ||
| antagonist; or | ||
| (2) any outcome resulting from the eventual | ||
| administration of the opioid antagonist. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
