SENATE BILL NO. 1003
AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee on the Judiciary
on February 10, 2020)

A BILL to amend the Code of Virginia by adding a section numbered 18.2-152.7:2, relating to computer crimes; monetary harm; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-152.7:2 as follows:

§18.2-152.7:2. Using computer to commit a scheme involving false representations; penalty.

Any person who maliciously uses a computer that is Internet capable as part of a scheme involving false representations that causes another person or business to expend monetary funds that would not have been expended if not for such scheme, when the person using such computer knew or should have known the monetary funds would be expended, is guilty of a Class 1 misdemeanor. It is not a defense to a violation of this section that the defendant did not receive any direct or indirect benefit from the defendant's malicious act.
