A bill to be entitled
2An act relating to a request for information by the
3Department of the Lottery; providing definitions;
4requiring the department to issue a request for
5information to determine the feasibility of entering into
6a management agreement with a manager to provide
7management services to the department; requiring a report
8to the Governor, President of the Senate, and Speaker of
9the House of Representatives; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  (1)  For purposes of this section, the term:
14     (a)  "Department" means the Department of the Lottery.
15     (b)  "Management agreement" means a contractual agreement
16entered into between the department and a manager to provide
17management services to the department. Under such agreement, the
18department shall continue to manage and operate the lottery.
19     (c)  "Manager" means an entity that provides management
20services to the department on behalf of the department under a
21management agreement.
22     (d)  "Request for information" means a written or
23electronically posted request made by an agency to vendors for
24information concerning commodities or contractual services.
25Responses to these requests are not offers and may not be
26accepted by the agency to form a binding contract.
27     (2)  The department shall issue a request for information
28to determine the feasibility of entering into a management
29agreement with a manager. The request for information, at a
30minimum, must obtain the following information:
31     (a)  How the vendor proposes to improve the operation of
32the department.
33     (b)  How the vendor proposes to increase lottery revenues.
34     (c)  The vendor's plan for implementing the proposed
35improvements.
36     (d)  The cost savings and increased revenues that would be
37generated by the vendor's proposals.
38     (e)  The vendor's proposed method of payment if awarded the
39management agreement.
40     (3)  The department shall report the following information
41to the Governor, President of the Senate, and Speaker of the
42House of Representatives no later than September 30, 2011:
43     (a)  A comparison of the management and operation of the
44department with the management and operation of other state
45lotteries.
46     (b)  A summary of the information gathered from the request
47for information.
48     (c)  A recommendation as to the feasibility of entering
49into a management agreement with a manager.
50     Section 2.  This act shall take effect July 1, 2011.
