House Memorial
2A memorial to the Congress of the United States, urging
3Congress to support the repeal of Section 511 of the Tax
4Increase Prevention and Reconciliation Act of 2005
5(TIPRA), which requires governments with annual spending
6in excess of $100 million to withhold a 3-percent federal
7tax on payments made for certain goods and services.

9 WHEREAS, state purchasing officials serve the public
10interest and are charged with maximizing the value of every tax
11dollar expended, and
12 WHEREAS, the unfunded mandate in Section 511 of Public Law
13109-222, 25 U.S.C. s. 342(t), will result in additional
14expenditures of human and budgetary capital to achieve agency
15compliance, and
16 WHEREAS, an increase in operating costs would result in
17significant reductions of support for critical services to the
18citizens of the State of Florida, and
19 WHEREAS, implementation of the unfunded mandate in Section
20511 of Public Law 109-222, 25 U.S.C. s. 342(t), will result in
21the diluted value of the taxpayer dollar, and
22 WHEREAS, the requirement of a 3-percent withholding not
23only places a substantial burden on state and local governments,
24it is detrimental to the small businesses that are the backbone
25of Florida's economy, NOW, THEREFORE,

27Be It Resolved by the Legislature of the State of Florida:

29 That the Congress of the United States is urged to repeal
30the unfunded mandate in Section 511 of Public Law 109-222, 25
31U.S.C. s. 342(t), including the passage of legislation to repeal
32this requirement as reflected in H.R. 275 and S. 292 of the
33111th Congress.
34 BE IT FURTHER RESOLVED that copies of this memorial be
35dispatched to the President of the United States, to the
36President of the United States Senate, to the Speaker of the
37United States House of Representatives, and to each member of
38the Florida delegation to the United States Congress.
