A bill to be entitled
2An act relating to a review under the Open Government
3Sunset Review Act; amending s. 787.03, F.S., which
4provides a public records exemption for information
5submitted to a sheriff or state attorney for the purpose
6of obtaining immunity from prosecution for the offense of
7interference with custody; removing the scheduled repeal
8of the exemption; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (c) of subsection (6) of section
13787.03, Florida Statutes, is amended to read:
14     787.03  Interference with custody.-
15     (6)
16     (c)1.  The current address and telephone number of the
17person and the minor or incompetent person which are contained
18in the report made to a sheriff or state attorney under
19paragraph (b) are confidential and exempt from s. 119.07(1) and
20s. 24(a), Art. I of the State Constitution.
21     2.  A sheriff or state attorney may allow an agency, as
22defined in s. 119.011, to inspect and copy records made
23confidential and exempt under this paragraph in the furtherance
24of that agency's duties and responsibilities.
25     3.  This paragraph is subject to the Open Government Sunset
26Review Act in accordance with s. 119.15 and is repealed on
27October 2, 2011, unless reviewed and saved from repeal through
28reenactment by the Legislature.
29     Section 2.  This act shall take effect October 1, 2011.
