SENATE BILL NO. 731

February 28, 2024, Introduced by Senators HAUCK, POLEHANKI, BELLINO, SINGH, WOJNO, MCCANN, SHINK, GEISS, HERTEL, BAYER, MOSS, WEBBER, VICTORY, SANTANA, HUIZENGA, KLINEFELT and CHANG and referred to the Committee on Regulatory Affairs.

A bill to amend 1998 PA 58, entitled

"Michigan liquor control code of 1998,"

by amending section 903b (MCL 436.1903b), as added by 2016 PA 434.

the people of the state of michigan enact:

Sec. 903b. (1) A retailer violates this act if the retailer or the retailer's clerk, servant, agent, or employee makes a payment to a wholesaler, the commission, or this state by any means that has been dishonored by a financial institution for lack of sufficient funds.any reason.

(2) If a retailer makes a payment to a wholesaler in violation of subsection (1), the retailer shall pay the wholesaler an administrative fee of $50.00.

(3) If a retailer makes a second payment in violation of subsection (1) to a wholesaler within 12 months after the first violation of subsection (1), the retailer shall pay the wholesaler an administrative fee of $150.00.

(4) If a retailer makes a third or subsequent payment in violation of subsection (1) to a wholesaler within 12 months after the first violation of subsection (1), the retailer shall pay the wholesaler an administrative fee of $300.00.

(5) Any fine ordered by the commission for a violation of subsection (1) must be deposited in the liquor control enforcement and license investigation revolving fund created under section 543.
