1.1A resolution
1.2affirming the sovereignty of the people of the State of Minnesota and memorializing
1.3Congress to act to nullify laws in violation of that sovereignty.
1.4WHEREAS, in the American system, sovereignty is defined as final authority, and the
1.5people, not government, are sovereign; and
1.6WHEREAS, the people of the State of Minnesota are not united with the people of the other
1.749 states that comprise the United States of America on a principle of unlimited submission to
1.8their federal government; and
1.9WHEREAS, all power not delegated by the people to government is retained; and
1.10WHEREAS, the people of the several states comprising the United States of America
1.11created the federal government to be their agent for certain enumerated purposes only; and
1.12WHEREAS, the Tenth Amendment to the Constitution of the United States of America
1.13reads as follows: "The powers not delegated to the United States by the Constitution, nor
1.14prohibited by it to the States, are reserved to the States respectively, or to the people"; and
1.15WHEREAS, powers too numerous to list for the purposes of this resolution have been
1.16exercised, past and present, by federal administrations, under the leadership of both Democrats
1.17and Republicans, which infringe on the sovereignty of the people of this state and may further
1.18violate the Constitution of the United States; and
1.19WHEREAS, when powers are assumed by the federal government, which have not been
1.20delegated to it by the people, a nullification of the act is the rightful remedy; that without this
2.1remedy, the People of this State would be under the dominion, absolute and unlimited, of whoever
2.2might exercise this right of judgment for them; NOW, THEREFORE,
2.3BE IT RESOLVED by the Legislature of the State of Minnesota that it affirms the
2.4sovereignty of the people of the State of Minnesota under the Tenth Amendment to the
2.5Constitution of the United States over all powers not otherwise delegated to the federal
2.6government by the Constitution of the United States.
2.7BE IT FURTHER RESOLVED that this resolution shall serve as a notice and demand
2.8to the federal government to cease and desist any and all activities outside the scope of its
2.9constitutionally delegated powers.
2.10BE IT FURTHER RESOLVED that the Legislature urges that a task force be appointed by
2.11Congress, which shall be charged with the task of nullifying specific federal laws and regulations
2.12which are outside the scope of the powers delegated by the people to the federal government
2.13in the Constitution.
2.14BE IT FURTHER RESOLVED that the Secretary of State of the State of Minnesota is
2.15directed to prepare copies of this memorial and transmit them to the President of the United States,
2.16the President and the Secretary of the United States Senate, the Speaker and the Clerk of the United
2.17States House of Representatives, and Minnesota's Senators and Representatives in Congress.
