A BILL TO BE ENTITLED
AN ACT to allow the driver of a vehicle to overtake and pass slower moving vehicles on portions of the highway which are marked by signs, markers, or markings placed by the department of transportation stating or clearly indicating that passing should not be attempted.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 20‑150(e) reads as rewritten:
"(e) The driver of a vehicle shall not overtake
and pass another on any portion of the highway which is marked by signs, markersmarkers,
or markings placed by the Department of Transportation stating or clearly
indicating that passing should not be attempted.attempted, except
that the driver of a vehicle may, subject to the requirements of subsections
(a) through (d) of this section, overtake and pass a stopped vehicle or a slower
moving vehicle. For purposes of this subsection, the term "slower moving
vehicle" includes tractors and other farm vehicles, trash collection
vehicles, mail delivery vehicles, mopeds, bicycles, and other vehicles operating
at speeds that are at least 10 miles per hour below the posted speed limit due
to the type and nature of such vehicles."
SECTION 2. This act becomes effective December 1, 2013. Prosecutions for offenses committed before the effective date of this act are not abated or affected by this act, and the statutes that would be applicable but for this act remain applicable to those prosecutions.
