A BILL TO BE ENTITLED

AN ACT to authorize the joint legislative education oversight committee to study the issue of whether student‑athletes should be paid stipends or otherwise be allowed to share in sports revenues collected by institutions of higher education.

The General Assembly of North Carolina enacts:

SECTION 1.  The Joint Legislative Education Oversight Committee may study the issue of whether student‑athletes should be paid stipends or otherwise be allowed to share in the various types of sports revenues generated by institutions of higher education, including revenues generated through all of the following: commercialization of a student‑athlete's name, image, or likeness; ticket sales; television rights; merchandise; and licensing agreements. In its study the Committee may consider all of the following:

(1)        The amount and type of revenue generated by intercollegiate sports and how those revenues are used by the institutions of higher education.

(2)        The current policies regarding the recruitment and retention of student‑athletes.

(3)        The academic eligibility requirements for and the quality of educational services provided to student‑athletes.

(4)        The opportunities provided by collegiate sports for student‑athletes to become professional athletes and the number of students‑athletes that successfully take advantage of those opportunities.

(5)        The recent decision of Edward O'Bannon v. NCAA and any appellate decisions rendered regarding that case.

(6)        Any other issue the Committee deems relevant to the study.

SECTION 2.  The Joint Legislative Education Oversight Committee may report on its findings, including any recommended legislation, to the 2016 Session of the 2015 General Assembly.

SECTION 3.  This act is effective when it becomes law.
