STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT establishing a public boat access donation program for operators of non-motorized boats and requiring the fish and game department to prepare a report relating to such program.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Fish and Game Commission; Report Required.  Within 2 years of the effective date of rules adopted pursuant to RSA 233-A:15, the fish and game department shall submit a report to the house fish and game and marine resources committee that describes how the donation program has been implemented and its success in raising revenue for public boat access.

2  New Section; Public Boat Access Program; Donations by Operators of Non-Motorized Boats.  Amend RSA 233-A by inserting after section 14 the following new section:

233-A:15  Donations by Operators of Non-Motorized Boats.  The executive director shall adopt rules pursuant to RSA 541-A to permit operators of non-motorized boats and others that use public boat access areas to make donations to support the development and maintenance of such areas.  The program may include various methods of advertising the program, such as posted signs at access areas, and recognizing those who have contributed, such as with a sticker, card, or letter of thanks.  All funds collected pursuant to this paragraph shall be deposited into the public boat access fund established in RSA 233-A:13.

3  Effective Date.  This act shall take effect 30 days after its passage.

METHODOLOGY:

This bill establishes a $10 annual registration fee for canoes and kayaks launched from public boat launches. Of the $10 fee, authorized agents with the Department of Safety processing the registration may retain $3.  The remaining amounts and any related fines shall be deposited as follows: 50 percent credited to the statewide public boat access fund and 50 percent credited to the lake restoration and preservation fund.  Since no method exists to determine how many kayaks or canoes currently use New Hampshire public boat launches and would require registration under this bill, state and local revenues and expenditures will be impacted by an indeterminable amount.  

 

The Department of Safety estimates the following costs due to this legislation:

  • the Department’s information technology systems (MAAP & VISION) will need to be reprogrammed for an estimated costs of $106,750;
  • municipalities acting as authorized agents may incur a cost for modifying their registration systems;
  • registration decals would need to be procured which recently cost the Department an average of 32 cents a decal;
  • public notice expenses, such as, mailings of notices to marinas and canoe and kayak retailers and the use of newspaper advertisements; and
  • the hiring a of a Cash Terminal Operator (CTO) I to process the increase in registrations.

This bill does not include an appropriation for the additional costs, therefore the Department estimates the navigation safety fund will primarily fund the increased expenditures required to implement this bill.

 

This bill could also result in an increase in municipal staffing, if municipalities determined  increased registrations warranted an increase in staffing.
