        AN ACT to amend the education law, in relation to the requirements for a
          license as a professional land surveyor; and providing for the  repeal
          of certain provisions upon expiration thereof

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 7206-a of the education law, as  added  by  chapter
     2  987  of the laws of 1971, paragraph 3 of subdivision 1 and subdivision 2
     3  as amended by chapter 32 of the laws of 1981, paragraph 6 of subdivision
     4  1 as amended by chapter 133 of the laws  of  1982  and  paragraph  8  of
     5  subdivision  1 and subdivision 3 as amended by chapter 62 of the laws of
     6  1989, is amended to read as follows:
     7    § 7206-a. Requirements for a license as a professional land  surveyor.
     8  1.  To  qualify for a license as a professional land surveyor, an appli-
     9  cant shall fulfill the following requirements:
    10    (1) Application: file an application with the department;
    11    (2) Education: have received an education, including a  bachelor's  or
    12  higher  degree  based on a program in land surveying, in accordance with
    13  the commissioner's regulations;
    14    (3) Experience: [(a) If the  applicant  has  a  bachelor's  or  higher
    15  degree,  have  at  least  four  years in work satisfactory to the board,
    16  provided that the board may accept study beyond the bachelor's degree in
    17  partial fulfillment of this requirement; or (b) If the applicant has  an
    18  associate's  degree, have at least six years in work satisfactory to the
    19  board provided that the board may accept study  beyond  the  associate's
    20  degree  in partial fulfillment of this requirement] Have practical expe-
    21  rience satisfactory to the department and in accordance with the commis-
    22  sioner's regulations;

     1    (4) Examination: pass an examination satisfactory to the board and  in
     2  accordance with the commissioner's regulations;
     3    (5) Age: be at least twenty-one years of age;
     4    (6)  Citizenship  or immigration status: be a United States citizen or
     5  an alien lawfully admitted for permanent residence in the United States;
     6    (7) Character: be of good moral character as determined by the depart-
     7  ment; and
     8    (8) Fees: pay a fee of [two hundred twenty dollars to  the  department
     9  for  admission  to a department conducted examination and for an initial
    10  license, a fee of one hundred fifteen dollars for each reexamination,  a
    11  fee of] one hundred thirty-five dollars to the department for an initial
    12  license  [for  persons  not  requiring admission to department conducted
    13  examination], and a fee of two hundred ten dollars  for  each  triennial
    14  registration period.
    15    2.  In  lieu  of the degree [and experience] requirements specified in
    16  [subparagraphs] paragraph (2) [and  (3)]  of  subdivision  one  of  this
    17  section,  [eight  years  of practical experience in work satisfactory to
    18  the board may be accepted, provided that each full year of college study
    19  in engineering or land surveying satisfactory to the department  may  at
    20  the  discretion  of  the  board  be  accepted in lieu of one year of the
    21  required eight years  of  experience]  an  associate's  degree  in  land
    22  surveying,  or  an associate's degree or higher in engineering, math, or
    23  related science with credits in land surveying acceptable to the depart-
    24  ment.
    25    [3. For an identification card as an "intern land surveyor", an appli-
    26  cant shall fulfill the requirements of subdivision one of this  section,
    27  except  those  in  subparagraphs (3) and (5), provided that admission to
    28  the examination may be given when the applicant is within twenty credits
    29  of the completion of the  requirements  for  the  bachelor's  or  higher
    30  degree  as  prescribed  in  subparagraph  (2) of subdivision one, or has
    31  completed the practical experience requirement  of  subdivision  two  of
    32  this  section.  The  fee  for  examination and identification card as an
    33  "intern land surveyor" shall be seventy dollars and  the  fee  for  each
    34  reexamination shall be seventy dollars.]
    35    2-a.  For admittance to the fundamentals of surveying examination, the
    36  applicant shall  fulfill  the  education,  experience,  and  examination
    37  requirements in accordance with the commissioner's regulations. Upon the
    38  successful  completion  of the examination, an identification card as an
    39  "intern land surveyor" shall be issued by the department.  The  fee  for
    40  examination  qualification  and  identification  card as an "intern land
    41  surveyor" shall be seventy dollars.
    42    2-b. In lieu of the degree and experience  requirements  specified  in
    43  paragraphs two and three of subdivision one of this section, eight years
    44  of  practical  experience  in work satisfactory to the department may be
    45  accepted, provided that each full year of college study  in  engineering
    46  or  land  surveying satisfactory to the department may at the discretion
    47  of the department be accepted in lieu of one year of the required  eight
    48  years of experience.
    49    §  2.  This  act shall take effect eighteen months after it shall have
    50  become a law; provided, however that subdivision 2-b of  section  7206-a
    51  of  the education law, as added by section one of this act, shall expire
    52  8 years after such effective date when upon such date the provisions  of
    53  such  subdivision  shall  be deemed repealed. Effective immediately, the
    54  addition and/or repeal of any  rule  or  regulation  necessary  for  the
    55  implementation  of  this  act  on  its effective date are authorized and
    56  directed to be made on or before such effective date.
