       AN ACT to amend the penal law, in relation to making the prostitution of
         a child by a parent or guardian a class B felony
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 230.32 of the penal law, as added by chapter 627 of
    2  the laws of 1978, is amended to read as follows:
    3  S 230.32 Promoting prostitution in the first degree.
    4    A person is guilty of promoting prostitution in the first degree when:
    5    1.  he  OR  SHE  knowingly  advances or profits from prostitution of a
    6  person less than eleven years old[.]; OR
    7    2. BEING A PARENT, GUARDIAN OR OTHER PERSON LEGALLY CHARGED  WITH  THE
    8  CARE  AND  CUSTODY  OF  A  CHILD LESS THAN EIGHTEEN YEARS OLD, HE OR SHE
    9  KNOWINGLY ADVANCES OR PROFITS FROM PROSTITUTION OF SUCH CHILD.
   10    Promoting prostitution in the first degree is a class B felony.
   11    S 2. This act shall take effect the first of November next  succeeding
   12  the date on which it shall have become a law.
