       AN ACT to amend the executive law, in relation to increasing the annuity
         of blind veterans or spouses of deceased blind veterans
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Paragraph a of subdivision 1 of section 362 of the execu-
    2  tive law, as amended by chapter 251 of the laws of 2004, is  amended  to
    3  read as follows:
    4    a. Any veteran as defined in this article who has been or is hereafter
    5  classified by the New York State commission for the visually handicapped
    6  as  a  blind  person as defined in section three of chapter four hundred
    7  fifteen of the laws  of  nineteen  hundred  thirteen,  as  amended,  and
    8  continues  to  be  a  blind  person  within the meaning of that section,
    9  shall, upon application to the director of  the  division  of  veterans'
   10  affairs,  be paid out of the treasury of the state for such term as such
   11  veteran shall be entitled thereto under the provisions of this  article,
   12  the sum of one thousand FIVE HUNDRED dollars annually, plus any applica-
   13  ble annual adjustment, as provided in this section.
   14    S 2. Paragraph a of subdivision 2 of section 362 of the executive law,
   15  as  amended  by  chapter  251 of the laws of 2004, is amended to read as
   16  follows:
   17    a. The unremarried spouse of a veteran who heretofore has died or  the
   18  unremarried  spouse  of a veteran dying hereafter, such veteran being at
   19  the time of her or his death a recipient of, or eligible for, the  bene-
   20  fits  above  provided, shall, upon application to the director of veter-
   21  ans' affairs, also be paid out of the treasury of the state the  sum  of
   22  one  thousand  FIVE HUNDRED dollars annually, plus any applicable annual
   23  adjustment, for such term as such unremarried spouse shall  be  entitled
   24  thereto under the provisions of this article.
   25    S 3. This act shall take effect immediately.
