STATE OF NEW YORK ________________________________________________________________________ 9789--A IN ASSEMBLY April 8, 2016 ___________ Introduced by M. of A. LENTOL -- read once and referred to the Committee on Real Property Taxation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to authorize Moses Jacobowitz Charitable Foundation to file an application for exemption from water and sewer charges for certain assessment rolls The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any other provision of law to the contrary, 2 the commissioner of the New York city department of environmental 3 protection is hereby authorized to accept from Moses Jacobowitz Charita- 4 ble Foundation, a not-for-profit corporation, an application for 5 exemption from water and sewer charges pursuant to section 420-a of the 6 real property tax law for the 2014 through 2015 assessment rolls, for 7 the parcel owned by such corporation in the city of New York, borough of 8 Brooklyn, designated as block 1750, lot 21 in such borough. If accepted, 9 the application shall be reviewed as if it had been received on or 10 before the taxable status date established for such assessment rolls. 11 If satisfied that such corporation would otherwise be entitled to such 12 exemption if such corporation had filed an application for exemption by 13 the appropriate taxable status date, the commissioner of the New York 14 city department of environmental protection, upon approval by the city 15 council of the city of New York, may grant exemption from all water and 16 sewer charges with respect to the subject tax rolls due and owing by 17 such corporation on the effective date of this act and cancel charges, 18 fines, penalties and interest remaining unpaid, and make appropriate 19 correction of the subject assessment rolls. 20 § 2.
