       AN ACT to amend the village law, in relation to allowing  the  municipal
         volunteer  fire  department  of  the  village  of Fishkill to have the
         option available to hold their annual meeting and election of  company
         and chief officers in December of each year
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 10-1010 of the village law, as amended  by  chapter
    2  719 of the laws of 1985, is amended to read as follows:
    3    S  10-1010 Election of company officers and delegates.  1. Each of the
    4  several companies whose members constitute the fire  department  of  the
    5  village  shall  hold  an annual meeting on the first Tuesday in April in
    6  each year. At such meeting the members of each company  shall  elect  by
    7  ballot  from  their  own  number  a  captain  and a lieutenant, and such
    8  further officers if any as may be provided for in  the  by-laws  of  the
    9  company,  who  must  be approved by the board of fire commissioners, one
   10  warden and one delegate to the general convention of  the  fire  depart-
   11  ment. The terms of office of the captain and lieutenant and such further
   12  officers  if  any, as are elected as herein provided, shall be one year,
   13  the wardens two years, and the delegates three years, respectively,  and
   14  any  vacancies occurring in any such offices shall be filled by election
   15  in like manner. At the first annual meeting  after  this  [act]  SECTION
   16  takes effect two wardens and three delegates shall be elected, the ward-
   17  ens  to serve for one and two years, respectively, and the delegates for
   18  one, two  and  three  years,  respectively.  Any  person  who  has  been
   19  convicted  of  arson in any degree shall not be eligible for election to
   20  the office of  captain,  lieutenant,  warden,  delegate  and  any  other
   21  offices  provided  for in the by-laws of the company. Any captain, lieu-
   22  tenant, warden,  delegate  or  other  officer  of  the  company  who  is

    1  convicted  of  arson  in  any  degree during his term of office shall be
    2  disqualified from completing such term of office.
    3    2.  NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION,
    4  IN THE VILLAGE OF FISHKILL, EACH OF THE SEVERAL COMPANIES WHOSE  MEMBERS
    5  CONSTITUTE THE FIRE DEPARTMENT OF THE VILLAGE SHALL HOLD AN ANNUAL MEET-
    6  ING  ON EITHER THE FIRST TUESDAY IN APRIL IN EACH YEAR, OR AT THE OPTION
    7  OF THE DEPARTMENT, THE FIRST TUESDAY IN DECEMBER IN EACH  YEAR.  IF  THE
    8  DEPARTMENT  ELECTS TO HOLD ITS ANNUAL MEETING IN DECEMBER, IT SHALL MAKE
    9  AVAILABLE TO THE GENERAL PUBLIC NEWS OF THE SCHEDULING OF THE MEETING NO
   10  LATER THAN THIRTY DAYS IN ADVANCE OF THE MEETING.
   11    S 2. This act shall take effect immediately.
