BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 122.177 of the Revised Code be | 6 |
enacted to read as follows: | 7 |
Sec. 122.177. (A) As used in this section: | 8 |
(1) "Business" means a sole proprietorship, a corporation for | 9 |
profit, or a pass-through entity as defined in section 5733.04 of | 10 |
the Revised Code. | 11 |
(2) "Career exploration internship" means a paid employment | 12 |
relationship between a student intern and a business in which the | 13 |
student intern acquires education, instruction, and experience | 14 |
relevant to the student intern's career aspirations. | 15 |
(3) "Student intern" means an individual who, at the time the | 16 |
business applies for a grant under division (B) of this section, | 17 |
meets both of the following criteria: | 18 |
(a) The individual is entitled to attend school in this | 19 |
state. | 20 |
(b) The individual is either between sixteen and eighteen | 21 |
years of age or is enrolled in grade eleven or twelve. | 22 |
(B) There is hereby created in the development services | 23 |
agency the career exploration internship program to award grants | 24 |
to businesses that employ a student intern in a career exploration | 25 |
internship. To qualify for a grant under the program, the career | 26 |
exploration internship shall be at least twenty weeks in duration | 27 |
and include at least two hundred hours of paid work and | 28 |
instruction in this state. To obtain a grant, the business shall | 29 |
apply to the development services agency before the starting date | 30 |
of the career exploration internship. The application shall | 31 |
include all of the following: | 32 |
(1) A brief description of the career exploration internship; | 33 |
(2) A signed statement by the student intern briefly | 34 |
describing the student intern's career aspirations and how the | 35 |
student intern believes this career exploration internship may | 36 |
help achieve those aspirations; | 37 |
(3) A signed statement by a principal or guidance counselor | 38 |
at the student intern's high school or, in the case of a home | 39 |
schooled student, an individual responsible for administering | 40 |
instruction to the student intern, acknowledging that the | 41 |
employment opportunity qualifies as a career exploration | 42 |
internship; | 43 |
(4) The name, address, and telephone number of the business; | 44 |
(5) Any other information required by the development | 45 |
services agency. | 46 |
(C)(1) The development services agency shall review and make | 47 |
a determination with respect to each application submitted under | 48 |
division (B) of this section in the order in which the application | 49 |
is received. The agency shall not approve any application under | 50 |
this section that is received by the agency more than three years | 51 |
after the effective date of H.B. 107 of the 130th general assembly | 52 |
or that was submitted by a business that does not have substantial | 53 |
operations in this state. The agency may not otherwise deny an | 54 |
application unless the application is incomplete, the proposed | 55 |
employment relationship does not qualify as a career exploration | 56 |
internship for which a grant may be awarded under this section, | 57 |
the business is ineligible to receive a grant under division | 58 |
(D)(1) of this section, or the agency determines that approving | 59 |
the application would cause the amount that could be awarded to | 60 |
exceed the amount of money in the career exploration internship | 61 |
fund. | 62 |
(2) The agency shall send written notice of its determination | 63 |
to the applicant within thirty days after receiving the | 64 |
application. If the agency determines that the application shall | 65 |
not be approved, the notice shall include the reasons for such | 66 |
determination. | 67 |
(3) The agency's determination is final and may not be | 68 |
appealed for any reason. A business may submit a new or amended | 69 |
application under division (B) of this section at any time before | 70 |
or after receiving notice under division (C)(2) of this section. | 71 |
(D)(1) In any calendar year, the development services agency | 72 |
shall not award grants under this section to any business that has | 73 |
received grants for three career exploration internships in that | 74 |
calendar year. The agency shall not award a grant to a business | 75 |
unless the agency receives a report from the business within | 76 |
thirty days after the end of the career exploration internship or | 77 |
thirteen months after the approval of the application, whichever | 78 |
comes first, that includes all of the following: | 79 |
(a) The date the student intern began the internship; | 80 |
(b) The date the internship ended or a statement that the | 81 |
student will continue to be employed by the business; | 82 |
(c) The total number of hours during the internship that the | 83 |
student intern was employed by the business; | 84 |
(d) The total wages paid by the business to the student | 85 |
intern during the internship; | 86 |
(e) A signed statement by the student intern briefly | 87 |
describing the duties performed during the internship and the | 88 |
skills and experiences gained throughout the internship; | 89 |
(f) Any other information required by the agency. | 90 |
(2) If the agency receives the report and determines that it | 91 |
contains all of the information and the statement required by | 92 |
division (D)(1) of this section and that the career exploration | 93 |
internship described in the report complies with all the | 94 |
provisions of this section, the agency shall award a grant to the | 95 |
business. The amount of the grant shall equal the lesser of the | 96 |
following: | 97 |
(a) Fifty per cent of the wages paid by the business to the | 98 |
student intern for the first twelve months following the date the | 99 |
application was approved; | 100 |
(b) Five thousand dollars. | 101 |
(E) A business that receives a grant under this section may | 102 |
submit a new application under division (B) of this section for | 103 |
another career exploration internship with the same student | 104 |
intern. Such an application does not have to include the | 105 |
statements otherwise required by divisions (B)(2) and (3) of this | 106 |
section. | 107 |
(F) Annually, before the seventh day of January until the | 108 |
January of the third year that follows the year that includes the | 109 |
effective date of H.B. 107 of the 130th general assembly, the | 110 |
development services agency shall compile a report indicating the | 111 |
number of career exploration internships approved by the agency | 112 |
under this section, the statements issued by the student interns | 113 |
under divisions (B)(2) and (D)(1)(e) of this section, the number | 114 |
of student interns that continued employment with the business | 115 |
after the termination of the career exploration internship, and | 116 |
the total amount of grants awarded under this section. The report | 117 |
shall not disclose any student interns' personally identifiable | 118 |
information. The agency shall provide copies of the report to the | 119 |
governor, the speaker and minority leader of the house of | 120 |
representatives, and the president and minority leader of the | 121 |
senate. | 122 |
(G) The development services agency may adopt rules necessary | 123 |
to administer this section in accordance with Chapter 119. of the | 124 |
Revised Code. | 125 |
(H) The career exploration internship fund is hereby created | 126 |
in the state treasury. The fund shall consist of a portion of the | 127 |
proceeds from the upfront license fees paid for the casino | 128 |
facilities authorized under Section 6(C) of Article XV, Ohio | 129 |
Constitution. Money in the fund shall be used by the development | 130 |
services agency to provide grants under this section. | 131 |
Section 2. All items in this section are hereby appropriated | 132 |
as designated out of any moneys in the state treasury to the | 133 |
credit of the designated fund. For all appropriations made in this | 134 |
act, those in the first column are for fiscal year 2014 and those | 135 |
in the second column are for fiscal year 2015. The appropriations | 136 |
made in this act are in addition to any other appropriations made | 137 |
for the FY 2014-FY 2015 biennium. | 138 |

Section 3. TRANSFER TO CAREER EXPLORATION INTERNSHIP FUND | 148 |
On July 1, 2014, or as soon as possible thereafter, the | 149 |
Director of Budget and Management shall transfer $1,000,000 cash | 150 |
from the Economic Development Programs Fund (Fund 5JC0) used by | 151 |
the Board of Regents to the Career Exploration Internship Fund | 152 |
(Fund 5NS0) used by the Development Services Agency. | 153 |
Section 4. Within the limits set forth in this act, the | 154 |
Director of Budget and Management shall establish accounts | 155 |
indicating the source and amount of funds for each appropriation | 156 |
made in this act, and shall determine the form and manner in which | 157 |
appropriation accounts shall be maintained. | 158 |
The appropriation contained in this act shall be accounted | 159 |
for as though made in Am. Sub. H.B. 59 of the 130th General | 160 |
Assembly. The appropriation made in this act is subject to all | 161 |
provisions of Am. Sub. H.B. 59 of the 130th General Assembly that | 162 |
are generally applicable to such appropriations. | 163 |
