    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 16.717,
    3         F.S.; creating the Federal Law Enforcement Trust Fund
    4         within the Florida Gaming Control Commission;
    5         providing the purpose of the trust fund; providing for
    6         sources of funds; providing that the trust fund is
    7         exempt from a certain service charge; providing for
    8         future review and termination or re-creation of the
    9         trust fund; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 16.717, Florida Statutes, is created to
   14  read:
   15         16.717 Federal Law Enforcement Trust Fund.—
   16         (1) The Federal Law Enforcement Trust Fund, FLAIR number
   17  41-2-719, is created within the Florida Gaming Control
   18  Commission.
   19         (2) The trust fund is established as a depository for funds
   20  to be used by the commission. Moneys to be credited to the trust
   21  fund shall consist of revenues received as a result of federal
   22  criminal, administrative, or civil forfeiture proceedings and
   23  receipts and revenues received from federal asset-sharing
   24  programs. The trust fund is exempt from the service charges
   25  imposed pursuant to s. 215.20.
   26         (3) Notwithstanding the provisions of s. 216.301 and
   27  pursuant to s. 216.351, any balance in the trust fund at the end
   28  of any fiscal year shall remain in the trust fund at the end of
   29  the year and shall be available for carrying out the purposes of
   30  the trust fund.
   31         (4) In accordance with s. 19(f)(2), Art. III of the State
   32  Constitution, the trust fund shall, unless terminated sooner, be
   33  terminated on July 1, 2028. Before its scheduled termination,
   34  the trust fund shall be reviewed as provided in s. 215.3206(1)
   35  and (2).
   36         Section 2. This act shall take effect July 1, 2024.
