A BILL TO BE ENTITLED

AN ACT TO DIRECT THE DEPARTMENT OF ENVIRONMENTAL QUALITY TO STUDY RIPARIAN BUFFER REQUIREMENTS FOR INTERMITTENT STREAMS, AS RECOMMENDED BY THE ENVIRONMENTAL REVIEW COMMISSION.

The General Assembly of North Carolina enacts:

SECTION 1.  The Department of Environmental Quality shall study whether the size of riparian buffers required for intermittent streams should be adjusted and whether the allowable activities within the buffers should be modified. The Department shall report the results of the study, including any recommendations, to the Environmental Review Commission no later than December 1, 2016.

SECTION 2.  This act is effective when it becomes law.
