STATE OF NEW YORK ________________________________________________________________________ 5281--A 2019-2020 Regular Sessions IN SENATE April 23, 2019 ___________ Introduced by Sen. SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT alienating certain parklands in the town of Stony Point, county of Rockland conveyed to said town pursuant to chapter 851 of the laws of 1973 The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act, the town of Stony 2 Point in the county of Rockland, acting by and through its town board, 3 is hereby authorized to discontinue as park lands, the lands more 4 particularly described in section two of this act. The commissioner of 5 general services shall amend a deed from the state to the town conveying 6 the lands described in section two of this act together with other 7 lands, upon such terms and conditions, including consideration as the 8 commissioner may determine to be fair and reasonable. 9 § 2. The lands referred to in section one of this act, situate in the 10 town of Stony Point, county of Rockland, state of New York, are located, 11 bounded and described as follows: 12 BEGINNING at a point at the southeast corner of lands conveyed to the 13 Town of Stony Point recorded in Book 81 of Patents at page 634, thence 14 the following fourteen (14) courses and distances: 15 1) N 74°23'00" W a distance of 1017.36 feet to a point; 16 2) N 08° 39' 27" W a distance of 817.69 feet to a point; 17 3) S 81° 11' 33" W a distance of 957.57 feet to a point; 18 4) S 00° 00' 00" E a distance of 493.17 feet to a point; 19 5) S 90° 00' 00" W a distance of 100.24 feet to a point; 20 6) N 00° 00' 00" W a distance of 863.57 feet to a point; 21 7) S 90° 00' 00" W a distance of 900.00 feet to a point; 22 8) N 00° 00' 00" W a distance of 917.21 feet to a point; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11166-02-9S. 5281--A 2 1 9) S 50° 56' 41" E a distance of 530.56 feet to a point; 2 10) N 03° 44' 23" E a distance of 221.85 feet to a point; 3 11) S 75° 01' 30" E a distance of 2399.62 feet to a point; 4 12) S 13° 14' 35" W a distance of 570.03 feet to a point; 5 13) S 75° 24' 47" E a distance of 650.32 feet to a point; and 6 14) S 14° 06' 25" W a distance of 795.62 feet to the point or place of 7 beginning. 8 Being a portion of lands conveyed by the People of the State of New 9 York to the Town of Stony Point recorded in the Department of State in 10 Book 81 of Patents at page 634, dated January 29, 1974. 11 CONTAINING 68.0 acres of land more or less. 12 § 3. In the event that the town of Stony Point received any funding 13 support or assistance from the federal government for the purchase, 14 maintenance or improvement of the parklands set forth in section two of 15 this act, the discontinuance and alienation of such parkland authorized 16 by the provisions of section one of this act shall not occur until the 17 town of Stony Point has complied with any federal requirements pertain- 18 ing to the alienation or conversion of such parklands, including satis- 19 fying the secretary of the interior that the alienation or conversion 20 complies with all conditions which the secretary of the interior deems 21 necessary to assure the substitution of other lands shall be equivalent 22 in fair market value and usefulness to the lands being alienated or 23 converted. 24 § 4. The description in section two of this act is not intended to be 25 a legal description but is intended to identify the parcel to be 26 conveyed. As a condition of the purchase, the town of Stony Point may be 27 required to submit to the commissioner of general services for his or 28 her approval an accurate survey and description of the lands to be 29 conveyed, which may be used in the conveyance thereof. 30 § 5. This act shall take effect immediately.
